Receiving a copy of a medical record
The medical information in the medical record and in the patient file is the patient’s personal and confidential information. Therefore, the patient, their natural guardian, or a person qualified for this purpose by the patient, or a person appointed for this purpose by a court order, is eligible to receive complete and up-to-date information about them over the course of their treatment.
According to the Patient’s Rights Law:
The patient’s right for medical information.
A patient is entitled to receive medical information out of their medical record from the treating physician or medical institution, including a copy of the information pertaining to them.
Procedures for photocopying a medical record:
- An official inquiry received by mail/email/fax, including: demographic details of the patient (full name, I.D. number, address, telephone), requested treatment dates, and a specification of the reasons for which a photocopy of the record is required.
- A Waiver of Medical Confidentiality signed by:
- The applicant/patient
- A natural guardian – parents, in case of a minor.
- A court-appointed legal guardian – with an enclosed Letter of Guardianship.
Signing a confidentiality waiver when a third party (family, friends) requests a copy, or an attorney or information gathering company, requires signature before a witness.
In case a deceased person’s information is required – their legal heir with an enclosed affidavit signed before an attorney or a Magistrates’ Court secretary, or their heir in accordance with an inheritance order or an order of probate, with the will enclosed.
In case a guardian had yet to be appointed – the information may be obtained by means of a court order.
3. For individuals who underwent an eye examination or eye surgery, as some of the files are in writing and some are computerized, the process may take up to 21 business days.
4. Receiving a copy of a medical record involves payment.
